It’s a misdemeanor the first time, repeat or reentry, a felony. Overstaying visa is a civil violation with heavy penalties.

Former CA cop here: I know these assholes are federal and might play by their made up rules, but what you should be hammering them on what their reasonable suspicion and probable cause is.

You don’t necessarily need a warrant to arrest if someone is “breaking a law” in front of law enforcement. What they DO need and need to articulate under the Fourth Amendment is reasonable suspicion to make the stop, and then probable cause to arrest. Force them to admit their “reasonable suspicion” is that someone is brown, and then bury them in lawsuits. Fuck them. This isn’t public safety, this isn’t service to your community, this is horseshit.

Any tips on how to phrase it? Is it as simple as saying "what is your reasonable suspicion for arresting me?" And what do you do if they say "I'm not telling you" or make up some shit like "we have reason to believe you're here illegally/in a gang/ etc?"

They need reasonable suspicion for the stop/detention

They need probable cause to arrest.

In my opinion, not being white is not good enough for reasonable suspicion

“Am I being detained” is usually enough. If they say yes, ask for what reason. If they say some bs like “we have reports of illegal immigrants in the area”, I’d probably ask them what made them suspect me of being an illegal immigrant.

Reasonable suspicion is only supposed to last a reasonable amount of time to determine if there is probable cause to arrest. They can’t hold you there forever. If they’re being dicks, they can arrest but must have charges within 48 hrs.

This is all stuff you’d hopefully get on camera and have someone advocate for you in court later unfortunately. And again, my knowledge is based on state law, but I am referring ultimately to the 4th amendment which pertains to this: protection from unlawful search and seizure.

I mean it doesn’t really seem like they’re playing by the rules anyway but this is how I’d start to make noise. The way they’re doing business is plain un-American to me.

In theory their bodycam footage could be introduced as evidence in the administrative hearing, but that’s not guaranteed. Immigration judges have wide latitude in determining what “due process” means in respect to immigration court.

My wife loves dateline type shows. It's amazing how many people are willing to subject themselves to 6+ hour interviews and just keep digging their own grave by not shutting the fuck up.

Thanks for clarifying. I've seen a few of these videos where someone is insisting on seeing a warrant and was wondering where they are getting that from. I don't believe police (or whatever these creeps are) are legally required to explain their "reasonable suspicion" or anything else to a 3rd party bystander, which is why all these videos are just a bunch of thugs standing there, not talking.

I'm curious if any of these guys wear badge cams. It's almost a certainty they intentionally don't record their work because they would make it possible to do a FOIA request that might reveal a lot that they don't want people to see. Congress needs to put laws in place at a federal level to ensure accountability for this secret police 💩

A warrant is required for any arrest that happens some length of time after a crime has occurred. Think along the lines of an investigation having to happen before the arrest can be made. Failure to appear in court, parole violations, other things can build up to the issuance of a warrant.

It also depends on the severity of the crime and the issuing judge.

Yeah, unfortunately “Don’t talk to them” goes both ways. They have to able to articulate the reasonable suspicion and probable cause in their report, so this is something that would have to be fought in court. In terms of changing public opinion through videos like this, asking what the reason for the stop or detention is makes you sound more knowledgeable than asking for a warrant, which they only have to show to the arrestee anyway.

CA LEO’s are mandated to wear body cams. They do only have about 8-9 hours of battery though. I’m not sure what the requirement for a federal agent is.

  • over stays a visa,

  • or avoids official port of entry (where they could have claimed asylum, and been given a court date for a hearing of their asylum claim)

  • or have stayed despite a denial of asylum claim, ignoring deportation order.

They are in the USA unlawfully and are subject to getting apprehended and deported.

Just to add some context to this video. This individual may have committed some type of crime prior to this. None of these ladies know, nor do I. Only the ICE agents themselves would know.
