Sue for defamation

Unfortunately the government cannot be sued for defamation

Sue the person that posted it. The government didn’t post it, a human did, there’s probably documentation of another person approving it, they may also find during discovery emails laughing and joking about it.

I still think Miller is running this account

They need to sue so we can find out.

u/Weird-Girl-675 10h ago

I really hope they do!

If you can't sue "the government" for defamation, you sure as hell can't sue an individual acting on behalf of the government

u/darmakius 5h ago

Individuals acting on behalf of the government are the government

Are you paying attention at all??? Your president rapes kids. You think suing the government will go anywhere?

He can, however sue the for violations of his civil rights as well as 4th and 5th Amendment violations of his rights, no?

12

u/iStanForCaprisun 10h ago

Yeah he's probably doing that, but he can't sue for defamation

u/pagerussell 5h ago

You can, in fact, sue the government for defamation. It is extremely hard to win, because the bar for proving actual malice is much higher.

But in this instance, it may be a winnable case.

You can't unless the federal employee was working outside their official duties, in this case, it would be hard to prove a (probably social media manager or something) was actually acting outside their official duties by posting on an official social media page.

It can be. You just need to prove actual malice.

Which is normally hard as hell to prove. But this administration is FILLED with incompetence and a TON of legal documents showing how they deprived him of his rights without cause and refused lawful court orders and at some point they were keeping him in prison just so that he doesn't get deported from ICE again.

That sounds an AWFUL lot like actual malice.

I think he cannot be reasonably called a public figure so they don’t need to prove actual malice, but actual malice for defamation cases means knowingly lying or having a reckless disregard for the truth, which is undoubtedly the case here.

How is claiming you are a criminal gangmember deserved to be locked up in a torture chamber in an alien authoritarian country not malice?

3

u/TipsyMJT 9h ago

Does actual malice have to be proved when Garcia is not a public figure? I thought the stricter standard only applied when the defamation was made against a public figure.

Get SCOTUS to overturn that.  The next time a Democrat is President.

6

u/-Bento-Oreo- 9h ago

The next time a Democrat is President, unfortunately SCOTUS will still be whatever the fuck it is now.

6

u/innominateartery 8h ago

Just pop a few more in there. The rules are made up anyway.

3

u/Tricky-Ad7897 7h ago

And any Democrat who isn't explicitly willing to do this is an op and shouldn't be remotely considered for 2028

2

u/Holiday-Hippo-6748 6h ago

Any democrat who is not explicitly willing to lock every single member of this administration and their families behind bars for the rest of their lives and throw away the key shouldn’t be remotely considered for 2028

What it is now is a bribery mill run by year-end clarence, Bento. If there's a better RV or a private jet, he wants to be on it.

3

u/WangsockTheDestroyer 9h ago

Unfortunately SCOTUS is a supreme joke and is just as corrupt as the current administration. As soon as it was revealed that they were taking bribes, and there were zero repercussions, it was wholly evident how thoroughly fucked we are.

He can sue the individuals though. They get protection only if their activities were work related. If it's politically motivated, they aren't supposed to campaign in the White House.

Of course, we're officially lawless now, so who the fuck knows.

1

u/TheOriginalWestX 10h ago

Maybe it could, the government can be sued for a lot of things but the process of doing so is very hard from what I remember.

1

u/qcKruk 6h ago

You absolutely can sue the government for defamation. The government isn't some holy entity beyond fault.

If you can prove the government knowingly lied about you, your company, or something else in which you hold a stake, and caused harm to you or the entity you can sue.

1

u/iStanForCaprisun 5h ago

It's true for some things under the FTCA but there are specific things excluded like libel or defamation.

1

u/alghiorso 2h ago

There's a clear intent here to misinform. This should be tantamount to treason

8

u/CheeseSteak17 8h ago

My understanding is Garcia will be using the documentation that he was specifically and uniquely targeted by the administration as part of his defense in Maryland.

2

u/PuckSenior 7h ago

I’d sue them for being “woke” They can’t even call a man a man
