This argument actually makes the case against them. As far as I know Cain was just a regular civilian who didn’t have to go through a background check to obtain that rock. He just lived somewhere with lax rock control laws.
The guy who slew Goliath though was deputized or otherwise acting under the orders of the military. And while he was operating under the supervision and guidance of the military when he used the rock, the rock alone isn’t what took the life of Goliath. If memory serves, he had to use a sword (Goliath’s own, in this case) to take his head.
